General Terms and Conditions of Providing Aesthetic Medicine and Cosmetology Services at Zakrzewscy Clinic sp. z o.o.

1. These General Terms and Conditions of Providing Aesthetic Medicine and Cosmetology Services at ZAKRZEWSCY CLINIC SP. Z O.O., hereinafter referred to as theGeneral Terms and Conditions of Service Provision," define the principles for the provision of services in the field of aesthetic medicine and cosmetology offered by ZAKRZEWSCY CLINIC SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Katowice (Porcelanowa 23B/8 Street, 40-246 Katowice), registered in the Register of Entrepreneurs of the National Court Register by the District Court Katowice-Wschód in Katowice, VIII Commercial Department under number (KRS): 0000699258, Business Identification Number (REGON): 368513088, Tax Identification Number (NIP): 9542783167, hereinafter: ZAKRZEWSCY CLINIC).
2. The General Terms and Conditions of Service Provision shall be presented each time to the Client for review and acceptance prior to commissioning ZAKRZEWSCY CLINIC to provide services in the field of aesthetic medicine and cosmetology.
3. The General Terms and Conditions of Service Provision, presented to the Client in accordance with the above paragraph, are binding for the Client.  
4. The General Terms and Conditions of Service Provision are also available at www.klinikazakrzewscy.pl and at the reception desk in the ZAKRZEWSCY CLINIC premises.
5. Services offered within ZAKRZEWSCY CLINIC shall be provided to adults with full legal capacity. Services may be provided to persons who do not have full legal capacity only with written consent of their statutory representative.
6. Prices of services offered within the ZAKRZEWSCY CLINIC are defined in the price list available at the ZAKRZEWSCY CLINIC premises and on the website www.klinikazakrzewscy.pl, including an up-to-date list of services offered with prices, which are expressed in PLN and are gross prices.

1. ZAKRZEWSCY CLINIC offers treatments in the field of aesthetic medicine and cosmetology. Detailed description of treatments performed as a part of the ZAKRZEWSCY CLINIC within the ZAKRZEWSCY CLINIC is available on the website www.klinikazakrzewscy.pl and all information is provided by the ZAKRZEWSCY CLINIC personnel.
2. All treatments in the field of aesthetic medicine and cosmetology are performed by people with knowledge, experience and specialist education. Aesthetic medicine treatments are performed by medical doctors. Treatments in the field of cosmetology are performed by certified cosmetologists and cosmetic technicians.
3. ZAKRZEWSCY CLINIC is entitled to condition the performance of treatments in the field of aesthetic medicine or cosmetology on prior medical examinations or consultations with the Client in order to determine the general state of health and detect any contraindications to perform a specific procedure. Medical examinations or consultations shall be carried out by the Client on its own, at its expense and risk.
4. Before entrusting ZAKRZEWSCY CLINIC with the provision of services in the field of aesthetic medicine and cosmetology, the Client shall be obliged to fill in an information sheet concerning, in particular, health condition, allergies, ailments, medications taken, past diseases and treatments as well as to submit a statement of consent to the treatment.
5. Before entrusting ZAKRZEWSCY CLINIC with the provision of services in the field of aesthetic medicine and cosmetology, the Client is obliged to provide the ZAKRZEWSCY CLINIC personnel with all relevant information on the Client’s health condition or any potential obstacles to proceed with the treatment. In particular, the Client is obliged to inform the personnel about any allergies, medications taken, diseases and medical treatments performed, including diseases of the circulatory system, lymphatic system, neurological, mental, skin, bone, cancer, inflammatory conditions in the acute phase, history of hepatitis, HIV infection and other viruses, pregnancy or postpartum period, prostheses, amalgams, metal implants in the body, pacemaker, cardioverter and history of stroke.
6. Each time a treatment is performed in a series, in which the intervals between successive treatments are longer than 7 days, the Client should confirm the validity of information provided, as referred to in the above paragraphs.
7. The Client acknowledges that failure to provide certain information contained in the paragraphs above may prevent the Client from achieving the desired effects of the aesthetic medicine or cosmetology treatment.
8. In case the Client provides false information or conceals data concerning diseases, illnesses, ailments or other circumstances that may constitute contraindication for carrying out the treatment, neither ZAKRZEWSCY CLINIC nor persons employed by or co-operating with the company shall be responsible for any negative effects of the treatment or its undesired consequences that could have been avoided if the Client had not provided false information or concealed the data.
9. The Client acknowledges that the final effect of treatments in the field of aesthetic medicine and cosmetology depends on individual body characteristics, including lifestyle, diet, level of physical activity, as well as age of the Client and compliance with post-treatment recommendations and cannot be guaranteed by ZAKRZEWSCY CLINIC.
10. ZAKRZEWSCY CLINIC has the right to refuse to carry out treatments in the field of aesthetic medicine or cosmetology if the Client does not meet basic requirements of personal hygiene, is under the influence of alcohol or drugs or there are doubts regarding the lack of health contraindications.
11. The Client is obliged to inform the ZAKRZEWSCY CLINIC personnel about any deterioration of his well-being during or after the performance of an aesthetic medicine or cosmetology treatment.
12. After the performance of treatment in the field of aesthetic medicine or cosmetology, the Client is informed about recommendations for further treatment, including the use or non-use of specific preparations, drugs or substances as well as about the possibility of performing other treatments within a specified time.

1. Treatments in the field of aesthetic medicine and cosmetology are performed after prior appointment booking. Reservations for selected treatments are made in person at the ZAKRZEWSCY CLINIC or by phone.
2. In case of impossibility to attend an appointment, the Client is obliged to cancel it at least 1 day in advance, which shall be understood as effective (by phone or in person) informing the ZAKRZEWSCY CLINIC personnel at least 24 hours in advance.
3. The Client acknowledges that being late for an appointment does not guarantee the performance of treatment, if the time necessary for its performance interferes with the punctual performance of treatment by another client, and for this reason the treatment time may be shortened accordingly to the lateness.
4. ZAKRZEWSCY CLINIC shall have the right to reschedule the agreed treatment, of which the Client shall be informed in advance. In cases of emergency and beyond the control of ZAKRZEWSCY CLINIC, the treatment shall be rescheduled as soon as possible after the situation arises. In other situations, the Client shall be informed about changing the date of treatment within 24 hours before the scheduled date.

1. Fees for aesthetic medicine and cosmetology treatments are determined on the basis of a price list available in the ZAKRZEWSCY CLINIC premises and on the website www.klinikazakrzewscy.pl.
2. Prices listed in the price list of services are subject to change as series and treatment packages are arranged individually for each Client.
3. Payment for aesthetic medicine and cosmetology treatments is made after the procedure.
4. Payment for aesthetic medicine and cosmetology treatments can be made in cash or with a credit or debit card.
5. ZAKRZEWSCY CLINIC carries out temporary special offers for the provided treatments. Taking advantage of a reduced price or promotional offer may be subject to separate rules that shall be communicated to the Client.

1. A gift card issued by ZAKRZEWSCY CLINIC is a document allowing payment for services in the field of aesthetic medicine and cosmetology offered by ZAKRZEWSCY CLINIC.
2. A gift card is issued for a service or a package of services chosen by the purchaser from the ZAKRZEWSCY CLINIC offer or a specific amount being an equivalent of the payment made for the purchase of a gift card.
3. The gift card is issued as a paper or plastic gift certificate.
4. The card can be used on condition that it is presented before entrusting ZAKRZEWSCY CLINIC with the provision of services in the field of aesthetic medicine and cosmetology.
5. Services purchased with a gift card are provided in accordance with these General Terms and Conditions of Service Provision.
6. One gift card can be used only by one person.
7. Minors may use the gift card only on condition that their legal representative gives them prior written consent to perform the procedure.
8. A gift card issued for a specified amount may be used for any service or product offered by ZAKRZEWSCY CLINIC.
9. A gift card issued for a specific amount can be used for more than one treatment if the total value of treatments does not exceed the gift card value. If the value of the total sum of treatments exceeds the gift card value, the Client shall be obliged to cover the difference in accordance with the ZAKRZEWSCY CLINIC price list valid on the day of card use.
10. The gift card holder is not entitled to receive an amount equal to the gift card value. If the value of a gift card issued for a certain amount is higher than the value of service provided by the gift card, the excess is not refundable in cash.
11. A gift card is valid from the date of its issuance until the date indicated on the gift card. After expiration date the gift card becomes invalid and the Client loses rights resulting from it. The expiry of a gift card shall not constitute any basis for making any claims against ZAKRZEWSCY CLINIC.

1. ZAKRZEWSCY CLINIC offers the possibility to purchase selected treatments of aesthetic medicine and cosmetology in packages.
2. The purchase of a package of aesthetic medicine or cosmetology treatments entitles a person who has purchased several treatments in the package to receive these treatments at a promotional price.
3. Aesthetic medicine or cosmetology treatments included in a package are carried out in accordance with these General Terms and Conditions of Service Provision.
4. The price for a package of aesthetic medicine and cosmetology treatments is paid in advance.
5. Aesthetic medicine or cosmetology treatments purchased as a part of one package may be used by only one person.
6. The purchase of a package of treatments in the field of aesthetic medicine or cosmetology obliges the Client to follow the recommendations of the ZAKRZEWSCY CLINIC personnel, including appropriate intervals between treatments.
7. The user of a package of treatments in the field of aesthetic medicine or cosmetology is obliged to inform the ZAKRZEWSCY CLINIC personnel of any changes occurring between treatments, which may affect the safety and effectiveness of treatments, including any emerging contraindications.
8. Treatments in the field of aesthetic medicine or cosmetology included in a given package of services offered at a promotional price are carried out only within the validity period of purchased package of services, and after expiry of this period ZAKRZEWSCY CLINIC may refuse to perform the treatment.
9. Package treatment cancelled the day of or on the day of appointment will be treated as performed.
10. The validity periods for packages of aesthetic medicine and cosmetology services offered are indicated below, calculated from the date of purchase of the respective package:

• package of 4 DPP laser skin rejuvenation treatments – 10 months;

• package of 4 and 6 tattoo removal treatments:

• 4 treatments – 12 months;
• 6 treatments – 16 months;

• package of 4 permanent makeup removal treatments – 8 months;
• package of 4 hyperpigmentation treatments – 10 months;
• package of 8 depilation treatments – 18 months;
• package of 3, 6, 12 LPG Alliance treatments:

• package of 3 treatments – 3 months;
• package of 6 treatments – 4 months;
• package of 12 treatments – 6 months;

• Storz package of 6 and 12 treatments:

• package of 6 treatments – 4 months;
• package of 12 treatments – 6 months;

• Onda package (4 treatments) – 6 months;
• package of 4 and 6 Accent Prime treatments – 6 months;
• package of 5 HydraFacial treatments – 8 months;
• package of 5 Dermapen treatments – 12 months;

11. Packages, including aesthetic medicine and cosmetology treatments, are not refundable or exchangeable for cash or other treatments

1. ZAKRZEWSCY CLINIC is committed to provide the highest quality services in the field of aesthetic medicine and cosmetology.
2. ZAKRZEWSCY CLINIC shall not be responsible for Client’s dissatisfaction with the final result of treatment in the field of aesthetic medicine or cosmetology resulting from subjective feelings of the Client if the treatment was performed in a professional manner, in accordance with the art and in a manner not substituting generally accepted standards.
3. ZAKRZEWSCY CLINIC shall not be held liable for negative consequences of treatments in the field of aesthetic medicine and cosmetology, which are the result of the Client’s failure to comply with its obligations, failure to follow recommendations or result from actions or omissions of persons employed in the Clinic, if these actions or omissions were not related to employee’s duties.

1. The Client has the right to withdraw from the agreement on entrusting ZAKRZEWSCY CLINIC with provision of services in the field of aesthetic medicine and cosmetology only in cases provided for by applicable law.
2. If performing a treatment in the field of aesthetic medicine or cosmetology involves the need to purchase preparations, medicines or substances by ZAKRZEWSCY CLINIC, the Client, withdrawing from the agreement, is obliged to cover the costs of their purchase. ZAKRZEWSCY CLINIC may deduct the amount due on this account from the amount of fees to be reimbursed to the Client.
3. In case of withdrawal from the agreement for the performance of which the Client has paid fees before the date of its execution, the fees shall be reimbursed – regardless of the method of payment – by transfer to the bank account indicated by the Client within 30 working days from the date of receipt by ZAKRZEWSCY CLINIC of the statement of withdrawal from the agreement. The bank account number shall be indicated in writing.

1. The Client has the right to lodge a complaint regarding the performance of cosmetic medicine or cosmetology treatment. The complaint should be made in writing immediately after establishing the grounds for lodging it. In order to make a complaint, it is necessary to prove that the treatment was performed at ZAKRZEWSCY CLINIC, in particular on the basis of the receipt relating to the service provided.
2. Within the scope of complaint processing, the Client shall be obliged to cooperate with ZAKRZEWSCY CLINIC, in particular to provide information related to the service subject to the complaint and to appear at the ZAKRZEWSCY CLINIC premises as far as this is necessary to determine the circumstances relevant for processing of the complaint.
3. Within 30 days of receipt of the complaint, ZAKRZEWSCY CLINIC shall inform the Client whether it accepts the complaint and shall propose a way to satisfy the claims on this account. If the complaint requires obtaining information from the Client, the deadline shall start on the day of obtaining the last information requested by ZAKRZEWSCY CLINIC.

1. In case of inappropriate behaviour of the Client or gross violation of order or the process of providing the services, the personnel shall have the right to refuse or discontinue providing the services and to ask the Client to leave the premises immediately. In such a situation, ZAKRZEWSCY CLINIC shall have the right to immediately terminate the agreement for services and retain the fee for services in full amount as compensation for incurred losses and lost benefits.
2. ZAKRZEWSCY CLINIC reserves the right to amend these General Terms and Conditions of Service Provision. New provisions shall be binding from the moment they are published on the ZAKRZEWSCY CLINIC premises. For the avoidance of doubt, the changes introduced shall not affect the performance of agreements concluded before their entry into force.
3. In case of any questions or doubts concerning the treatments offered within ZAKRZEWSCY CLINIC the personnel is available at the company’s office as well as at phone numbers and e-mail addresses available on the website www.klinikazakrzewscy.pl.
4. The provisions of Polish law, in particular the Civil Code and the Consumer Rights Act of May 30, 2014, shall apply to matters not regulated in these General Terms and Conditions of Service Provision.
5. Any disputes arising from the implementation of provisions of these General Terms and Conditions of Service Provision shall be considered by the common court whose jurisdiction shall be determined in accordance with the provisions of the Civil Procedure Code Act of November 17, 1964.
